These terms govern your use of topvaper.com (“Top Vaper”, “we”, “us”). By using the platform – browsing, voting, registering, or creating polls – you agree to them. They’re written in plain language on purpose.
1. Who may use Top Vaper
You must be of legal vaping age in your country or region (21+ in the United States, 19+ in most Canadian provinces, 18+ in the UK and most of the EU). By entering the site or creating an account you confirm that you are. We may remove accounts we reasonably believe belong to underage users.
Top Vaper is an opinion-polling platform. We do not sell, advertise for sale, or ship vaping products, and nothing on this platform is an offer to sell them.
2. Your account
One account per person. You’re responsible for keeping your password secure and for what happens under your account. Don’t impersonate other people or brands, and don’t create accounts to evade a suspension or to vote more than once. We may suspend or delete accounts that break these terms.
3. Voting integrity
The entire value of this platform rests on one rule: one person, one vote, and money cannot buy a result. Accordingly, you agree not to:
- vote more than once in a poll by any means – multiple accounts, multiple devices, cleared cookies, VPNs, or scripts;
- use bots or automation to vote or to create accounts;
- offer or accept anything of value in exchange for votes, or organize schemes to manipulate results.
We use technical measures to prevent duplicate and automated voting. Where we detect manipulation, we may remove the affected votes, void or restate a poll’s results, and suspend the accounts involved – including after results were published. Our determination of what constitutes manipulation is final.
4. Community polls
Registered members may create polls. All polls are reviewed by a moderator before publication, and we may decline or remove any poll at our sole discretion. Polls must:
- relate to the vaping space;
- not be advertising, self-promotion, or disguised brand campaigns – if you’re a brand, run a verified campaign instead;
- not contain unlawful, defamatory, hateful, or misleading content, and not make health or therapeutic claims about any product;
- not target, disparage, or harass any person.
Poll questions and options you submit remain yours, but you grant us a perpetual, worldwide, royalty-free licence to publish, display, and archive them and their results on the platform and in our communications about it. We may edit poll wording for clarity or compliance; where the edit is material we’ll note it.
5. Verified campaigns
Verified campaigns are run together with a sponsoring brand under a separate agreement with that brand. Voting in a verified campaign requires a personal invitation link; each link is valid for one vote. Results are published when voting closes. Sponsorship, advertising, and campaign fees buy reach and placement on Top Vaper – they never buy votes, rankings, or results.
6. Results, badges, and how you may use them
Published results are provided for general interest. They reflect the votes cast under the conditions of each poll and are not a warranty of product quality, safety, or fitness for any purpose. Winner badges we issue may be displayed by the named winner, linked to the corresponding results page, and must not be altered or used to imply endorsement of any product or claim beyond the poll actually won. We may revoke a badge if the underlying result is voided under section 3.
7. Acceptable use of the platform
Don’t probe, attack, overload, scrape at scale, or attempt to gain unauthorized access to the platform or its data. Don’t post other people’s personal information. Security researchers acting in good faith are welcome to report issues via our contact form.
8. Our content
The Top Vaper name, logo, badges, site design, and platform code are ours. Aggregate published results may be quoted and shared with attribution and a link to the results page – in fact, we encourage it.
9. Disclaimers and limitation of liability
The platform is provided “as is” and “as available”, without warranties of any kind, express or implied. We don’t guarantee uninterrupted operation, error-free results, or that any poll outcome will be acted on by any brand. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the platform, and our total liability for any claim is limited to CAD $100. Nothing in these terms limits liability that cannot be limited under applicable law, including under Canadian and Ontario consumer protection legislation where it applies to you.
10. Ending things
You can delete your account at any time via our contact form (see the Privacy Policy for what happens to your data). We may suspend or terminate accounts that violate these terms. Sections that by their nature should survive – content licences, disclaimers, liability limits – survive termination.
11. Changes
We may update these terms as the platform evolves. Material changes will be reflected in the effective date above, and continued use after a change means the updated terms apply.
12. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it. Disputes belong to the courts of Ontario, except where the consumer protection law of your place of residence gives you a non-waivable right to a different venue.
